I. General Terms

  • Terms and Conditions – these terms and conditions
  • Service – the internet service "NETY.pl", operating at the address https://nety.pl/en
  • Service Provider – the company "ZP20 Piotr Markowski" with its registered office at: KEN 36/112B, WARSAW, POLAND, Tax ID: 9482256434,
  • Service User – any individual who accesses the Service and uses the services provided via the Service by the Service Provider.
  • Electronic Communication – Communication between parties via email and contact forms available on the website.

II. General Provisions

  • The Terms and Conditions define the rules of functioning and usage of the Service and specify the rights and obligations of the Service Users and the Service Provider related to the use of the Service.
  • The subject of the Service Provider’s services is to provide free tools in the form of the Service, enabling Service Users to access content in the form of entries, articles, audiovisual materials, or web applications and electronic forms.
  • Any content, articles, and information that have the characteristics of guidance or advice published on the Service are only a general set of information and are not directed to individual Service Users. The Service Provider is not responsible for their use by Service Users.
  • The Service User assumes full responsibility for the manner of using the materials made available within the Service, including using them in accordance with applicable law.
  • The Service Provider does not guarantee the suitability of the materials posted on the Service.
  • The Service Provider is not responsible for any damages incurred by Service Users of the Service or third parties in connection with the use of the Service. All risks related to the use of the Service, especially the use and application of information placed on the Service, are borne by the Service User using the Service.

III. Terms of Use of the Service

  • Use of the Service by each Service User is free and voluntary.
  • Service Users are required to read the Terms and Conditions and other documents constituting its integral part and must accept its provisions in full to continue using the Service.
  • Service Users may not use any personal data obtained from the Service for marketing purposes.
  • Technical requirements for using the Service:
    • A device with a display that allows viewing web pages,
    • Internet connection,
    • Any web browser that displays web pages according to the standards and provisions of the W3C Consortium and supports web pages available in HTML5,
    • JavaScript enabled,
    • Cookie support enabled
  • To ensure the security of the Service Provider, Service Users, and other Service Users using the Service, all Service Users using the Service should follow the generally accepted guidelines for safe internet browsing.
  • It is prohibited to perform actions personally or using software that:
    • Decompile and analyze source code without written consent,
    • Cause excessive load on the Service server without written consent,
    • Attempt to detect security vulnerabilities of the Service and server configuration without written consent,
    • Attempt to upload or inject code, scripts, or software that may harm the Service software, other Service Users, or the Service Provider,
    • Attempt to upload or inject code, scripts, or software that may track or steal data of Service Users or the Service Provider,
    • Attempt to damage, block the operation of the Service, or prevent the achievement of the Service’s purpose.
  • If a Cybersecurity incident or GDPR violation is detected or there is a potential possibility of occurrence, Service Users should report it to the Service Provider immediately to quickly resolve the problem/threat and secure the interests of all Service Users of the Service.

IV. Registration Terms and Conditions

  • Service Users can use the Service without registration.
  • Service Users must be registered and have an account on the Service to use additional services provided on the Service, available only to logged-in Service Users.
  • Registration on the Service is voluntary.
  • Registration on the Service is free.
  • Each Service User can have only one account on the Service.
  • Technical requirements for account registration:
    • Having an individual email account.
  • Service Users registering on the Service consent to the processing of their personal data by the Service Provider to the extent entered into the Service during the registration process and any subsequent changes or deletions.
  • The Service Provider has the right to suspend or delete Service Users’ accounts at its discretion, thereby preventing or limiting access to certain or all services, content, materials, and resources of the Service, especially if the Service User violates the Terms and Conditions, generally applicable laws, social coexistence principles, or acts to the detriment of the Service Provider or other Service Users, the justified interest of the Service Provider, and third parties cooperating or not with the Service Provider.
  • All Service services may be changed in terms of their content and scope, added or removed, and also temporarily suspended or restricted in access, at the discretion of the Service Provider, without the possibility of objections in this regard by the Service Users.
  • Additional security rules for account use:
    • It is forbidden for registered Service Users to share their login and password with third parties.
    • The Service Provider has no right and will never request the Service User’s password for the chosen account.
  • Account deletion:
    • Each Service User with an account on the Service can independently delete the account from the Service.
    • Service Users can do this after logging into the panel on the Service.
    • Deleting the account results in the deletion of all identifying data of the Service User and anonymization of the username and email address.

V. Newsletter Service Terms

  • Service Users can use the Service without subscribing to the Newsletter.
  • Subscribing to the Newsletter service is voluntary.
  • Subscribing to the Newsletter service is free.
  • Technical requirements for the Newsletter service:
    • Having an individual email account.
  • Terms of the Newsletter service:
    • Providing an individual email account in the electronic form,
    • Verifying the provided email account by activating the link sent to it,
    • Agreeing to receive email notifications.
  • Scope of the Newsletter service:
    • Notifying about new updates, posts, competitions, and other promotional activities related to the Service’s services,
    • Notifying about promotional activities of the Service’s partners (Marketing messages).
  • Unsubscribing from the Newsletter service:
    • Each Service User subscribed to the Newsletter service can independently unsubscribe from the service.
    • Service Users can do this via the link provided in each sent email.
    • Unsubscribing from the Newsletter service results in the removal of the provided email address from the Service Provider’s database.

VI. Terms of Communication and Provision of Other Services on the Service

  • The Service provides services and tools enabling Service Users to interact with the Service in the form of:
    • Contact form
    • Commenting on posts and articles
  • The Service provides contact details in the form of:
    • Email address
  • If a Service User contacts the Service Provider, the personal data of the Service Users will be processed in accordance with the "Privacy Policy", which is an integral part of the Terms and Conditions.
  • Terms of posting content by Service Users on the Service:
    • It is prohibited to post offensive or defamatory content towards the Service Provider, other Service Users, third parties, and third-party entities,
    • It is prohibited to post textual, graphic, audiovisual materials, scripts, programs, and other works for which the Service User does not have a license or the copyright holder has not agreed to free publication,
    • It is prohibited to post vulgar, pornographic, erotic content that is inconsistent with Polish and European law, as well as links to sites containing the indicated content,
    • It is prohibited to post scripts and programs that excessively load the server, illegal software, software for violating security, and other similar actions, as well as links to sites containing the indicated materials,
    • It is prohibited to post marketing and advertising content for other commercial services, products, services, or commercial websites

VII. Collecting Data about Service Users

To properly provide services by the Service, secure the legal interest of the Service Provider, and ensure compliance with applicable law, the Service Provider, through the Service, collects and processes some data about Users.

To properly provide services, the Service uses and stores some anonymous information about the Service User in cookies.

The scope, purposes, methods, and principles of data processing are available in the appendices to the Terms and Conditions: „GDPR Information Obligation” and „Privacy Policy„, which are an integral part of the Terms and Conditions.

  • Data collected automatically:
    For the proper functioning of the Service and for statistics, we automatically collect some data about the Service User. These data include:
    • IP address
    • Browser type
    • Screen resolution
    • Approximate location
    • Pages visited within the Service
    • Time spent on each page
    • Type of operating system
    • Previous page address
    • Referring site address
    • Browser language
    • Internet connection speed
    • Internet service provider
    • Anonymous demographic data based on Google Analytics data:
      • Gender
      • Age
      • Interests

    The above data is obtained through the Google Analytics script and is anonymous.

  • Data collected during registration:
    Username, first and last name, email address

    For logged-in Service Users (those with an account on the Service), a user ID linked to the Service User’s account may be placed in cookies stored on the Service User’s device.

  • Data collected when subscribing to the newsletter:
    Email address

VIII. Copyright

  • The owner of the Service and the copyrights to the Service is the Service Provider.
  • Some data posted on the Service is protected by copyrights belonging to companies, institutions, and third parties not affiliated with the Service Provider, and is used under obtained licenses or based on a free license.
  • Under the Act of February 4, 1994, on copyright, it is prohibited to use, copy, reproduce in any form, and store in search engine systems, except for Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook, and LinkedIn, any articles, descriptions, photos, and all other content, graphic materials, videos, or audio found on the Service without written consent or consent provided via Electronic Communication from their legal owner.
  • According to the Act of February 4, 1994, on copyright, simple press information, understood as mere information without commentary and evaluation by the author, is not protected. The author understands this as the possibility of using information from the texts posted on the Service, but not copying the entire or parts of the articles unless indicated in the particular material shared on the Service.

IX. Changes to the Terms and Conditions

  • All provisions of the Terms and Conditions may be changed unilaterally by the Service Provider at any time, without giving reasons.
  • Information about changes to the Terms and Conditions will be sent electronically to Service Users registered on the Service.
  • In case of changes to the Terms and Conditions, the new provisions will take effect immediately after their publication for Service Users without an account on the Service.
  • In case of changes to the Terms and Conditions, the new provisions will take effect after a 7-day transition period for Service Users with accounts registered before the changes.
  • It is considered that any Service User continuing to use the Service after changes to the Terms and Conditions accepts them in full.

X. Final Provisions

  • The Service Provider is not responsible in any way, as far as the applicable law allows, for content transmitted and published on the Service by Service Users, for their truthfulness, reliability, authenticity, or legal defects.
  • The Service Provider will make every effort to ensure the Service’s services are offered continuously. However, it does not bear any responsibility for disruptions caused by force majeure or unauthorized interference by Service Users, third parties, or external automated programs.
  • The Service Provider reserves the right to change any information posted on the Service at any chosen time, without the need to notify Service Users using the Service’s services.
  • The Service Provider reserves the right to temporarily, entirely, or partially disable the Service to improve it, add services, or perform maintenance without prior notification to Service Users.
  • The Service Provider reserves the right to permanently disable the Service without prior notification to Service Users.
  • The Service Provider reserves the right to assign all or part of its rights and obligations related to the Service without the consent and possibility of objections from the Service Users.
